Marriages occurring in WA since 1841 are registered in the Western Australian Registry of Births, Deaths and Marriages.

The Marriage Act 1961 requires the authorised celebrant, within 14 days of the date of marriage, to forward the marriage papers to the Registry of Births, Deaths and Marriages for registration.

Overseas marriages

There is no provision to register an overseas marriage in Australia.

An overseas marriage would be generally recognised as a legal marriage if it is similar in nature to a marriage conducted in Australia. For example, if the bride and groom were both over the age of 18 years, not married to another person and not in a prohibited relationship (ie, closely related).

The overseas country's registry authorities will register the marriage and can provide you with a marriage certificate as proof of the marriage.

The marriage certificate may require an official translation if not in English.

Privacy & Disclosure of Information

The collection of information is authorised by the Births, Deaths and Marriages Registration Act 1998. This information is used for registering life events occurring in Western Australia and issuing certificates.

Access to certificates is only approved in accordance with the Registry's Certificate Access and Identification policies. General information regarding these policies is available from the Registry's website at Marriage Certificate Access Policy and Identification Requirements.

Registry legislation also allows the Registrar to release information to approved agencies for statistical purposes, medical research, community planning, law enforcement and other uses provided for by law.

Customer warning - online certificate companies

The WA Registry of Births, Deaths and Marriages is aware that some private companies have set up official-looking websites to charge people for downloading copies of birth, death and marriage forms. The forms are available on this website for the public to download at no cost.

These companies have no affiliation with the Registry and any complaints about their operations should be directed to the WA Department of Commerce's Consumer Protection division.
